Welcome to Diagnohab Malaysia Sdn Bhd (“we,” “us,” or “our”). By accessing or using our website, services, or products (collectively, the “Services”), you agree to comply with and be bound by the following terms and conditions (the “Terms of Use”). Please read these Terms of Use carefully. If you do not agree with any part of these Terms of Use, please do not use our Services.

DEFINITIONS

"Diagnohab" refers to Diagnohab Malaysia Sdn. Bhd.

“Services” refers to Diagnohab’s website, mobile application, consultation service, products, solutions including Diagnohab Scan, and related services.

“Diagnohab Scan” refers to preventive healthcare with artificial intelligence driven diagnotistics provided by Diagnohab

"User"refers to any individual or entity accessing or using the Service.

"Content" includes text, data, graphics, software, and other materials provided through the Service.

"Personal Data" refers to any information that can identify an individual, as defined by applicable privacy laws.

1. ACCEPTANCE OF TERMS

1.1 These Terms of Use ("Terms") govern your access to and use of the Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1.2 Diagnohab may update these Terms of Use from time to time. Your continued use of the Services after changes have been made constitutes your acceptance of the revised Terms of Use.

2. USE OF THE SERVICES

2.1 You must be at least 18 years old or have parental consent to use the Services.

2.2 You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:

Use the Services in any way that violates any applicable law or regulation.
Engage in any activity that interferes with or disrupts the Services or the servers and networks connected to the Services.
Impersonate or attempt to impersonate any person or entity, including Diagnohab, its employees, or any other users.
Distribute viruses, malware, or any other harmful code that may compromise the security of the Services.
Reproduce, copy, modify, distribute, or create derivative works of the Services without our explicit consent.

2.3 You acknowledge that Diagnohab provides recommendations based on AI analysis and does not replace professional medical advice.

2.4 You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations.

3. ACCOUNT REGISTRATION

3.1 To access certain features, you may need to create an account.

3.2 You agree to provide accurate and complete information during registration and to update it as necessary.

3.3 You are responsible for maintaining the confidentiality of your account credentials.

4. PRIVACY AND DATA PROTECTION

4.1 We collect, process, and store your Personal Data in accordance with our Privacy Policy which can be found at www.diagnohab.com/privacy-policy.

4.2 By using the Service, you consent to our data collection and usage practices as outlined in our Privacy Policy.

5. INTELLECTUAL PROPERTY RIGHTS

5.1 All Content and materials available through the Service are owned by or licensed to Diagnohab.

5.2 You may not copy, modify, distribute, or use any Content without prior written consent.

6. DISCLAIMERS AND LIMITATION OF LIABILITY

6.1 The Service is provided "as is" without warranties of any kind.

6.2 Diagnohab does not guarantee the accuracy, reliability, or completeness of any recommendations provided.

6.3 We are not responsible for any decisions made based on the Service.

6.4 To the extent permitted by law, Diagnohab and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Services.

6.5 Diagnohab’s total liability for any claim arising out of or relating to the Services shall not exceed the amount you have paid to us (if any) for the specific Services giving rise to the claim.

7. USER CONTENT

7.1 By submitting or posting any content to the Services (e.g., comments, feedback, reviews), you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, distribute, and display your content in connection with the Services.

7.2 You represent and warrant that:

You own or control all rights to the content you submit.
Your content does not infringe on the intellectual property, privacy, or other legal rights of any third party.
Your content does not contain any defamatory, offensive, or unlawful material.

7.3 Diagnohab reserve the right to remove any user content that violates these Terms of Use or that Diagnohab deem inappropriate at its sole discretion.

8. THIRD-PARTY LINKS

8.1 The Services may contain links to third-party websites or services that are not owned or controlled by Diagnohab. Diagnohab is not responsible for the content, privacy policies, or practices of any third-party websites. Diagnohab encourage you to review the terms and conditions and privacy policies of any third-party websites before using them.

9. DIAGNOHAB SCAN

9.1 Fees

9.1.1 Diagnohab charges you a fee of Ringgit Malaysia (RM) 298.00 for Diagnohab Scan by charging the fees to your credit card, debit card, banking account, e-wallets. The fee to be charged is as indicated before your purchase and such fees are subject to change at the discretion of Diangohab at any time without prior notice.

9.2 Orders

9.2.1 You can purchase Diagnohab scan via website and make payments by any payment methods offered by Diagnohab’s appointed payment service provider Axaipay.

9.2.2 After you confirm your order, you shall receive a receipt of the purchase. You shall proceed to the selected Diagnohab’s outlet to use the Service purchased. You shall schedule your appointment prior your visit to the selected Diagnohab’s outlet.

9.2.3 Once completed Diagnohab scan, Diagnohab’s system will generate a report contains AI-Predicted Health Index based on the User’s data. The report will be sent to the Users within 3-5 business days via digital channels such as email or WhatsApp.

9.2.4 If you need to consult with Diagnohab’s Health Management Consultant regarding the report, you shall schedule the appointment with Diagnohab prior to the visit.

10. REFUND POLICY

10.1 There shall be no refund once service has been purchased or/and rendered. A refund will be given under the following conditions:

The service was not delivered due to a technical error or system failure on Diagnohab's end.
The customer was charged incorrectly or was double-billed.
The service provided did not match the description or scope outlined at the time of purchase.

11. TERMINATION

11.1 We reserve the right to suspend or terminate your access to the Service at any time for violations of these Terms or other reasons.

11.2 Upon termination, your right to use the Service will cease immediately.

12. MODIFICATION TO THE TERMS

12.1 We may update these Terms from time to time.

12.2 Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. GOVERNING LAW AND DISPUTE RESOLUTION

13.1 These Terms are governed by the laws of Malaysia.

13.2 Any disputes arising out of or related to these Terms of Use or the Services shall be subject to the exclusive jurisdiction of the courts of Malaysia.
